Welcome to MiniTill. These Terms of Service explain the rules for using MiniTill's websites, applications, point-of-sale tools, order management tools, and related services.
By creating an account, using MiniTill, or accessing our services, you agree to these Terms. If you do not agree, you must not use MiniTill.
1. About MiniTill
MiniTill is a point-of-sale and order management platform designed for cafés, bakeries, takeaway shops, restaurants, and other hospitality businesses.
MiniTill may include features such as POS order entry, menu management, customer records, loyalty, discounts, online ordering, kitchen display screens, printing, reporting, integrations, and payment-related workflows.
2. Who may use MiniTill
You may use MiniTill only if you are authorised to act on behalf of the business, store, or organisation you register or manage.
You are responsible for ensuring that all staff, managers, contractors, and other users who access your MiniTill account comply with these Terms.
3. Accounts and access
You must provide accurate account, business, billing, and contact information.
You are responsible for keeping your login credentials secure. You must notify us promptly if you believe your account has been accessed without permission.
MiniTill may support different user roles, such as owner, business manager, store manager, cashier, or support roles. You are responsible for assigning appropriate access levels to your users.
4. Business and store data
You retain ownership of the business data you enter into MiniTill, including products, menus, orders, customer records, loyalty information, reports, and store configuration.
You grant MiniTill permission to process, store, display, transmit, and use that data as necessary to provide, maintain, secure, and improve the service.
You are responsible for the accuracy, legality, and appropriateness of the data you enter into MiniTill.
5. Customer information and privacy
If you collect or manage customer information through MiniTill, you are responsible for ensuring that your use of that information complies with applicable privacy, marketing, and consumer laws.

6. Subscriptions, billing, and plans
MiniTill may offer free and paid plans. Paid plans may include different limits, features, stores, devices, integrations, support levels, or usage allowances.
Subscription pricing, included features, and limits may be shown on the MiniTill website, billing page, or plan selection screen.
Unless stated otherwise:
- subscription fees are charged in advance;
- fees are non-refundable except where required by law or expressly stated by MiniTill;
- you are responsible for all applicable taxes, duties, and charges;
- failed payments may result in restricted access, downgrade, suspension, or cancellation.
MiniTill may use third-party payment providers, such as Stripe, to process subscription payments. Your use of those payment services may also be subject to the provider's own terms.
7. Promotions and discounts
MiniTill may offer promotions, free trials, coupons, discounts, or introductory pricing.
Promotions may be subject to eligibility rules, expiry dates, usage limits, plan restrictions, or other conditions.
MiniTill may withdraw or change promotions where reasonably necessary, but this will not affect promotional benefits already granted unless misuse, fraud, error, or a breach of these Terms is involved.
8. Acceptable use
You must not use MiniTill to:
- break the law;
- infringe another person's rights;
- upload malicious code or attempt to compromise the service;
- access data you are not authorised to access;
- interfere with MiniTill's systems, security, or availability;
- reverse engineer, copy, resell, or misuse the service except as permitted by law or by written agreement;
- use MiniTill for fraudulent, misleading, abusive, or harmful activity.
9. POS, payments, printing, and integrations
MiniTill may integrate with third-party services, hardware, payment terminals, printers, accounting systems, delivery platforms, online ordering tools, and other providers.
Third-party services and hardware are not controlled by MiniTill. Availability, performance, transaction approval, settlement timing, device compatibility, printing reliability, surcharges, refunds, and provider errors may depend on those third parties.
You are responsible for checking order, payment, refund, till closing, tax, accounting, and settlement records before relying on them for business, tax, or accounting purposes.
MiniTill is not a bank, payment processor, accountant, tax adviser, or financial adviser.
10. Service availability and changes
We aim to provide a reliable service, but MiniTill may be unavailable from time to time due to maintenance, updates, outages, network issues, third-party provider issues, or events outside our control.
We may add, change, limit, suspend, or remove features where reasonably necessary to improve the service, maintain security, comply with legal obligations, manage third-party dependencies, or support the long-term operation of MiniTill.
11. Support
Support availability may depend on your plan, the nature of the issue, and the support channels offered by MiniTill.
We may provide help through email, in-app support, documentation, or other channels.
12. Intellectual property
MiniTill owns or licenses all rights in the MiniTill platform, software, design, branding, documentation, workflows, and related materials.
You may use MiniTill only as allowed by these Terms. You must not copy, modify, distribute, sell, lease, or create derivative works from MiniTill unless we give written permission or the law allows it.
13. Feedback
If you provide ideas, suggestions, bug reports, feature requests, or other feedback, you allow MiniTill to use that feedback without restriction or payment to you.
14. Suspension and termination
You may stop using MiniTill at any time.
MiniTill may suspend or terminate access if:
- you breach these Terms;
- your subscription payment fails;
- your use creates security, legal, operational, or reputational risk;
- we are required to do so by law;
- the service or a major part of it is discontinued.
Where practical, we will try to give reasonable notice before suspension or termination, but immediate action may be required in serious cases.
15. Data export and deletion
Where available, you may export certain business data from MiniTill.
After account closure, cancellation, or termination, MiniTill may retain data for a reasonable period for backup, legal, tax, fraud prevention, security, dispute resolution, or operational purposes.
We may delete inactive, expired, or closed account data in accordance with our data retention practices.
16. Disclaimers
MiniTill is provided on an “as is” and “as available” basis.
To the extent permitted by law, we do not guarantee that MiniTill will be uninterrupted, error-free, compatible with every device or integration, or suitable for every business requirement.
Nothing in these Terms limits any rights that cannot legally be excluded.
17. Liability
To the extent permitted by law, MiniTill is not liable for indirect, incidental, special, consequential, or loss-of-profit damages, including losses caused by outages, incorrect setup, user error, third-party services, hardware failure, payment provider issues, internet connectivity, or inaccurate data entered by users.
To the extent permitted by law, MiniTill's total liability for claims relating to the service is limited to the amount paid by you to MiniTill for the service in the three months before the event giving rise to the claim.
18. Consumer and business laws
MiniTill is primarily provided for business use.
Some laws, including New Zealand consumer, fair trading, privacy, and contract laws, may apply despite these Terms. Nothing in these Terms is intended to exclude, restrict, or modify rights or obligations that cannot legally be excluded.
19. Changes to these Terms
We may update these Terms from time to time.
If changes are material, we will take reasonable steps to notify users, such as by posting the updated Terms on our website, showing an in-app notice, or contacting account owners.
Your continued use of MiniTill after the updated Terms take effect means you accept the updated Terms.
20. Governing law
These Terms are governed by the laws of New Zealand.
Any dispute relating to these Terms or MiniTill will be handled under New Zealand law, unless another law applies and cannot be excluded.
